- The employee must provide a medical certificate stating the presumed date of delivery.
- The employee benefits from a reduction in working hours:
- As from the third month of pregnancy, pregnant women benefit from a reduction in their usual working hours of 60 minutes per day if employee works at least 6 hours a day and 30 minutes if employee works more than 4 and less than 6 hours a day. This reduction results in no reduction in salary. This time is split between the arrival and departure time or taken during the day as a break- with the agreement of her manager.
- Absences
When obligatory pre-natal consultations take place during working hours, the working time lost will be paid to the person concerned who should advise the employer in good time.
As from July 1st, 2009, on top of the obligatory examinations envisaged for the antenatal period (article L. 154 of the Public Health Code) and which allow paid absences when the examinations take place during the working time, Amadeus also authorizes, during the antenatal period, paid absences for the expectant mothers, to carry out the following supplementary examinations: glycemia levels (O’ Sullivan test), amniocentesis and the down syndrome test. A maximum of 2 additional examinations are granted per pregnancy.
- Medical observation
The work doctor will ensure that the working conditions are not prejudicial to the normal development of the pregnancy
Maternity Leave
The future mother may benefit from maternity leave, the length of which varies according to the number of children already born and to the number of newborns she will have (i.e. single birth, twins, triplets):
- The employee may decrease the prenatal leave by a maximum of 3 weeks, but the post-natal leave must be increase by the same amount.
Maintenance of salary
Employees who have more than one year’s seniority within the company at the date they stop work for maternity leave will conserve the integrity of the monthly salary during the legal maternity leave. Since 01/05/2007 (for the maternity leave beginning after the 30th of April 2007), seniority is not taken account for the maintenance of salary : all maternity leave conserve the integrity of the monthly salary during the legal maternity leave.
Focus on mothers returning from maternity leave.
As you may know, up to on year as from the birth of the child, French law grants you one hour dedicated to expressing milk or breast feeding your child during your working day if so wish.
Amadeus has allocated dedicated rooms to give you the opportunity to breast feed your child or express milk in suitable and comfortable conditions.
Parental Leave
At the end of the maternity leave, the father or the mother may ask either for unpaid leave, or part-time work (weekly working hours to be between 16 and 32 hours).
- Conditions:
Must have more than 1 year’s seniority at the date of birth of the child. - Duration:
The non-paid parental leave or part-time work is initially for a maximum period of one year. This may be extended twice but will end at the date of the third birthday of the child.
The request for an extension of the period of leave must be received by the company at least one month before the end of the initial period of leave. - Procedures:
The employee must inform the company by recorded delivery letter of the start date and the length of the leave from which they wish to benefit:
– at least 1 month before the end of the maternity leave if the parental leave is to follow on immediately,
– at least 2 months before the start date of the parental leave, in all other cases.
The Company must receive the request for the extension by recorded delivery letter, at least 1 month before the end of the initial period of leave.
In the case of parental leave on a part-time basis, with a split of the working hours over less than 5 days, the company has the possibility of asking the employee to modify his/her desired working days in order to reconcile the department’s requirements.
Paternity Rights
Days for children’s birth
Amadeus grants 3 days off (paid working days) to employees in a civil union (PACS) in the case of the birth or adoption of a child, and this, whatever the sex of employee. The 3 days off can be consecutive or not, but must be taken within a 15 day period either side of the day of the birth or following the arrival at the home of the child to be adopted.
Paternity leave
Any employee (whatever their sex) who is in a civil union (PACS) will be granted the benefit of the full 11 days’ leave (Saturdays and Sundays included) for a single birth or adoption (or 18 days for multiple births or adoptions). The paternity leave must begin within the 4 months following the birth of the child.
However, this leave can be postponed beyond the 4 months in the following cases:
• death of the mother (in this case, the paternity leave must be taken within the 4 months following the end of the specific leave which the father benefits from in a such situation)To be noted:
• at least 1 month before the chosen date of the beginning of the paternity leave.
